TERMS OF SERVICE

This website and online store are operated by Mad Productions Comm.V., trading under the name Benjamin Van Oost (“we”, “us”, “our”).

By using this website or placing an order, you agree to these Terms of Service. Nothing in these Terms limits any mandatory consumer rights under applicable law.

1. Products

Our collection may include original artworks, limited editions, handmade objects, clothing, accessories, prints and made-to-order or commissioned pieces.

Because many items are handmade or artist-produced, minor variations in colour, texture, finish, dimensions or appearance may occur. These characteristics do not constitute a defect where the product otherwise corresponds to its description.

Colours may also appear slightly different depending on photography, lighting and screen settings.

2. Original & Limited Works

Original artworks are unique and may only be available once. Limited editions may be numbered, signed and/or supplied with a certificate of authenticity.

In the unlikely event that a unique work has already been sold through another authorised channel before our inventory is updated, we may cancel the order and issue a full refund.

3. Orders & Prices

All orders are subject to availability and successful payment.

We reserve the right to refuse or cancel an order in case of fraud, product unavailability, obvious pricing or technical errors, or incorrect customer information.

If we cancel a paid order, the relevant payment will be refunded.

4. Made-to-Order & Custom Pieces

Custom, commissioned or personalised products may be created specifically according to the customer's individual specifications.

Where permitted by law, such products may be excluded from the statutory right of withdrawal.

Any applicable exclusion will be clearly communicated before purchase.

5. Shipping

Delivery times are estimates unless expressly guaranteed.

Customers are responsible for providing correct shipping information.

For deliveries outside the European Union, customs duties, import taxes and local charges may apply and are generally the responsibility of the customer.

6. Returns

Returns and refunds are governed by our Returns & Refund Policy.

Nothing in these Terms excludes your statutory rights concerning defective, damaged or non-conforming goods.

7. Intellectual Property

Purchasing an artwork means purchasing the physical object only.

Copyright and other intellectual property rights remain with Benjamin Van Oost and/or the relevant rights holder unless expressly transferred in writing.

The artwork may not be reproduced, commercially copied, printed on merchandise, licensed, used for advertising or otherwise commercially exploited without prior written permission.

8. No Investment Guarantee

We do not guarantee the future value, resale price, appreciation or market demand of any artwork, edition or collectible.

The purchase of art should not be considered financial or investment advice.

9. Damage & Installation

Where products require hanging, mounting or installation, the customer is responsible for ensuring that installation is carried out safely and appropriately.

We are not responsible for damage caused by incorrect installation, misuse, improper handling or failure to follow supplied instructions, except where liability cannot legally be excluded.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from the use of our website or products.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

11. Website Content

We may update product information, prices, images and website content from time to time.

Unauthorised reproduction or commercial use of website content, images, designs, artworks or branding is prohibited.

12. Governing Law

These Terms are governed by Belgian law, without prejudice to mandatory consumer protection rights applicable in the customer's country of residence.
